1. Who you are agreeing with

These terms are an agreement between you and ELK Consulting Ltd, the company identified on our Legal notice page, which operates ELK GameVerse — this website, the web app, the mobile applications, and every game on the platform.

By creating an account, or by playing as a guest, you accept these terms. If you do not accept them, do not use the platform.

2. Who may use it

You must be old enough to agree to a contract where you live, or have a parent or guardian who agrees on your behalf. Individual games carry their own age rating in the store listing, and that rating governs the game.

If you are a parent and your child uses ELK GameVerse, you are responsible for their use of it, including any purchase made on your device.

One account per person. You may not sell, rent, share or transfer an account, and you may not use somebody else's.

3. Your account

You choose a password; keep it to yourself. Tell us at contact@elkgameverse.com if you think somebody else has it.

The platform assigns you a handle — a unique name other players can use to add you as a friend. There is no player search and no directory, so your handle only reaches people you give it to.

You may delete your account at any time from the account page. Deletion is described in the Privacy Policy and is not reversible: progress, in-game currency and anything you unlocked are gone with it.

4. What we let you do, and what we do not

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use ELK GameVerse for your own entertainment.

You may not:

  • cheat, or use software that plays for you, or modify a game client;
  • interfere with the servers, or attempt to reach data that is not yours;
  • reverse-engineer the platform except where the law expressly allows it;
  • copy, scrape or republish the games, artwork, text or data;
  • create accounts in bulk, or use one account to gain an advantage on another;
  • sell in-game currency or items, or offer to;
  • use the platform to break the law, or to harm anyone.

The Community Guidelines describe conduct in more detail and form part of these terms.

5. Results are what the server says they are

Every finished game is replayed on our servers from the moves your device sent, and the score we record is the one that replay produces. A score your device claims and our replay does not reproduce is refused.

This is the rule that makes the leaderboards mean anything, and it applies to everyone equally. Section 10 of the Privacy Policy explains your right to have a human review a decision made this way.

6. Virtual currency and items

In-game currency, boosters, cosmetics and unlocks are a limited licence to use a feature inside the platform. They are not your property, they have no monetary value, they cannot be exchanged for money, and they cannot be transferred between accounts.

We may change the price, the earn rate or the effect of an item where doing so is necessary to keep a game balanced or the economy sound. Where a change materially reduces something you paid real money for, section 8 applies.

If your account is closed for breaking these terms, unspent currency and unredeemed items are lost.

7. Buying things

On mobile, purchases go through Google Play Billing or Apple's In-App Purchase, and those stores take the payment. We never see your card details. Every purchase is verified against the store's own servers before anything is credited to your account.

Prices are shown before you confirm, in the currency the store charges in. Taxes are handled by the store.

Subscriptions, where offered, renew automatically until you cancel them, and you cancel through the store rather than through us, because the store holds the subscription.

A purchase gives you what the listing described. If it does not, that is a refund question — see the Refund Policy.

8. Advertising

Advertising on ELK GameVerse is always optional. You will never be required to watch an advertisement to continue playing, to keep progress, or to avoid losing something. Where an advertisement is offered it is in exchange for something extra, and refusing costs you nothing but the extra.

We will ask for your consent before showing you personalised advertising, and you can withdraw it in your settings at any time.

9. Changing the platform

We add games, change features, run events and retire things. Where we retire something you paid real money for and it was not consumed, we will tell you before it happens and either provide an equivalent or refund the unconsumed part.

We may suspend the platform for maintenance. We try to do it when few people are playing, and to say so in advance.

10. Ending it

You may stop at any time and delete your account.

We may suspend or close an account that breaks these terms. Where the breach is minor we warn first. Where it is serious — cheating, fraud, harming another player, attacking the platform — we may act immediately.

If we close your account you may contest it at support@elkgameverse.com, and a person will look at it. If we were wrong, we restore the account.

If we discontinue ELK GameVerse entirely, we will give at least 60 days' notice, stop selling anything during that period, and refund the unconsumed part of any purchase made in the 12 months before the announcement.

11. Who owns what

The platform, its games, artwork, text, music, code and the ELK marks belong to us or to the people we licensed them from. Nothing in these terms transfers any of it to you.

Where a game draws on real history, the historical facts belong to nobody; our presentation of them is ours. Sources are cited in the games themselves.

If you send us feedback, we may use it without owing you anything for it. If you believe something on the platform infringes your rights, write to contact@elkgameverse.com with enough detail to identify it.

12. What we promise, and what we do not

We provide the platform with reasonable skill and care, and we will fix faults we can fix. We do not promise it will be uninterrupted, error-free, or available in every country.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything a consumer's rights cannot be limited for. Where the law allows a limit, our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before it arose, or £50.

If you are a consumer, you have rights under your own country's law that these terms cannot take away, and nothing here is intended to.

13. If something goes wrong between us

Tell us first: support@elkgameverse.com. Most things are a misunderstanding and are fixed in a day.

These terms are governed by the law of the jurisdiction named in our Legal notice, and disputes go to its courts — except that if you are a consumer in the European Union or the United Kingdom you keep the right to bring proceedings where you live, under your own law.

EU consumers may also use the European Commission's online dispute resolution platform.

14. Changes to these terms

We will give at least 30 days' notice of a change that affects your rights or what you pay, in the app and by email where we have one. Continuing to use the platform after that means you accept it; if you do not, delete your account before the change takes effect and section 10 applies.

15. The rest

If a clause turns out to be unenforceable, the rest still stands. Not enforcing a term once does not waive it. These terms, the Privacy Policy, the Cookie Policy, the Refund Policy and the Community Guidelines are the whole agreement between us about ELK GameVerse.

This document is written in English and translated. If a translation and the English text disagree, the English text governs.
